well no from what I understand the loci/r390/r420 whatever they call it is simply a massive updateof the current core to 13 micron plus the other aditions mentioned. They are actually farther ahead then that. I dont know how much. But nv40 will most likely not hit shelves till early next year. I know that nvidia really needs to get that part out though.
As for speed. it is said that loci will be faster than the original r400 would have been. Whetever it means it is said that loci is brute force and the original r400 now r500 uses finess.
To me this means not much but that is what mufu and a few others have been hinting at.

Well from what I understand R400 was more feature based, with less focus on speed. Loci is based on the R300 core, with some of R400's features, and is more focused on speed. As I understand it Loci is not going to be launched before Comdex, so if nvidia can get NV40 in stores by December it will be very good for them, as they should win in the feature department, and may very well win in the speed department too.

yes this is all true and yes just checked in the last few days rumors are starting to show up about nv40 by years end. We shall see what happens. One thing is for shure I hope it's fast enough that they dont have ot cheat to get decent scores. I really mean it.
With patch 330 and murk going ( and I dont care that they are still able to cheat in thier latest drivers without using the smae technics ) the 5800 ultra only pulling 3200 3dmarks puts it even slower than a radeon 9500. I assume that the 5900 is not going ot really be much faster than that. I really hope the nv40 can perform without cheating it would be nice. as a matter of fact I hope it is faster than nvidia even drempt of so they can put away all he cheats and give the users a true idea of the performace they can really get and expect form all thier games and not just those ones that happen to have a couple megs of driver cheats built in.

I think that'll be a close run thing. Obviously, they will both be aiming to beat the other when it comes to getting the product launched and shipping.

NV40 should be quite advanced over the R420 going by everything I've heard. The extra features NV40 will have won't make any difference to gamers really in the short to medium term, but it'll look good on a spec sheet.

Well, like you said, with the 44.61 drivers the cheats seem to have disappeared. Of course it all seems a little too convenient. So it would be impossible to substantiate whether or not the NV40 drivers are using cheats to achieve their high scores IMO....in synthetic benchmarks anyway.
