Is Nvidia cheating in the Splinter Cell benchmark?

Why would Nvidia need to cheat rendering pixel shader 1.1 ?They have no problem with standard pixel shaders of 1.1, Heck they helped microsoft design the specification.

Because you can always make things faster if you don't render everything, or cut down the length of the shader, to give yourself an edge over the competition.

nVidia apparantly have personnel working solely on looking at Splinter Cell benchmarks, which seems somewhat unusual to me.
