Well, it isn't a bug of the patch. The game does it too.

When you think that there's a bug, do alt-tab, change the options in the .ini file, do alt-tab again, and check the result (the configuration tool is very handy for this task).

I'm using that driver too for XP-32, and seems ok, better than the previous, and slightly better performance.
