I dont think the same shaders are used. There was an example pic of what sunrays looked like in dx9..and then dx10, and dx10 looked more natural and solid while the dx9 mearly looked like these trails of light tethered from edges of things.
Its like the water, its not that the effects arnt there for dx9, its that they arnt the same, and that the dx10 is better and slower.
