That part I'm not sure of. They may not have to... they may only have to sue the person who's in care or charge of the computer. In recent history, though, I think the record companies have only sued people who are clear violators (sharing thousand upon thousands of copyrighted files) and it's easy to identify who was at the keyboard. But I agree, it's a sticky situation.
In Canada it's case law that an ISP does not have to divulge the personal information of a user for copyright infringement. Doesn't mean they won't, but they are under no obligation to.
