The chips themselves are not malfunctioning; they're simply the wrong chip for the product. As such, there isn't anything for NVIDIA to announce.
However, if you could persuade your OEM (seller/manufacturer) to contact NVIDIA sales and marketing, they should be able to obtain confirmation/explanation. It's possible they'll need to be persistent to get through to the correct person to handle this. Please let me know if you/they have difficulties with this; if so, I will try to do what I can to facilitate this.
If you have a Windows machine, you may also be able to persuade them by demonstrating that HW video acceleration isn't available there too, e.g. using the "DXVA info" tool.
