It is not a technical problem. It is a legal problem. Force triple buffer in a D3D driver is against the rules for a d3d driver. If you allow this you will lost WHQL.
The solution for NVidia is simple. Just make triple buffer for D3D games an option that is disabled unless coolbits is loaded. Then they get the WHQL and we get easy triple buffering in D3D.
