Default Ex won't release my phone, but can it still be sold?

There's a number of places that buy used phones, but considering my ex won't release the phone to me I'm wondering if it can still be sold? I've not seen any stipulations that the phone can't be tied to an account, but I have to wonder what they're going to do with it once it's purchased if it is tied to an account?

I'm certainly not able to use the phone my self, so if it goes through a used phone dealer does it somehow magically become usable again? Or is the dealer screwed if its tied to an account? Either way it seems I can sell it and have money in my pocket, so I guess it doesn't matter what they do with it, but still I'm curious.

If it's a GSM phone, just change sims, no big deal.

If it's a CDMA phone, then forget about using it with sprint or verizon (at&t/t-mobile as well since they only use GSM.) It may be usable with the smaller CDMA carriers such as cricket, boost mobile, metro pcs, bluegrass cellular, and a few others, but it can be a real pain in the ass to try to reprogram it for these carriers, and for some of them you may have a difficult time getting them to accept it. It's kind of a crapshoot, and virtually nobody would buy it for that unless it was sold for dirt cheap.

It's an original DROID from Verizon, so I guess that means CDMA from what I have read.

Gazelle.com gives me a price quote of $72 for my Droid, both through their site and newegg, and they will even send a pre paid shipping package. I guess they would have to reprogram if for one of the smaller carriers? Certainly it can't be used with Verizon again. It wouldn't surprise me if she told verizon it was stolen. Sort of pisses me me off she did this becuase I was a good little boy and paid up all that I owed her, and the weekend we had agreed to have it switched to my own name she demanded another $120, and when I wouldn't pay it she immediatly had them shut me off.
