Im wondering if I could lock the FPS to 32 in D3, A friend and myself are having a small argument about weather the game would smoother with the FPS caped or not. (hes got a 5950 256MB and even 50+ fps the game plays jerky some times.
So does anyone know how to reset the FPS cap?

the best solution for this would be to enable vsync. there is no obvious way to change the frames per second cap on the game, as they have implemented new things that deal with the FPS and capping it etc. would suggest vsync, it would probably be your best route of smoothing out the game.
good luck on it... if it's having hitching (like occasionally lagging, but not all the time), then it probably has to do with either video ram or physical ram.

You probably want a FPS minimum of 35 in any case.
