I don't think they advertise anything as rendered, only as the resolutions that it outputs to. There are numerous games that don't render in 720p.... it doesn't mean anything.

Theres also many games that claim to be 1080i/p but are merely upscaled. Does that mean we can sue all them too? more frivolous lawsuits. imagine if we could sue a company for releasing a game that didn't have a feature that was advertised in a previous press release/interview/ect.

well, when Bungie wins, the attorneys will more than likely be ordered to pay their legal fees by the court as well.

There's no way they can win this. Upscaled still draws the pixels at the higher res, some of them are just the same color.
