Microsoft faces class action lawsuit due to Xbox Live outages

While we usually scoff at class action lawsuits for seemingly petty reasons, the plaintiffs have an excellent point -- Microsoft must have expected an influx of server-taxing Xbox Live subscribers around the holidays, yet they "failed to provide adequate access and service to Xbox Live and its subscribers." The ball appears to be in your court, Microsoft -- that better be one hell of a free arcade game.

Wow, I guess some people were in dying need of playing Halo Online during holiday seasons

Yeah I doubt I'd go that far, but at very least it might up the freebie a little. One free months subscription + an arcade game anyone?

Microsoft with their bottomless pockets and incredible technology centers couldn't provide adequate service to XBL customers... they better damn well know they're going to get slapped with a lawsuit. The worst part of this is that if it's true that Microsoft breeched their own contract by not providing adequate service to customers, then this could get really ugly for Microsoft.

it's in the xbox live ToS that the Live Service is an "as is" service, meaning that if it goes down, you have to deal with it. This lawsuit will get throw out quicker than Hunt at a Flatley convention.
