Default NVRM Xid beef3097 bug report attached

Just hoping someone can tell me if this is software or hardware. I'd say hardware, I bought this card used, supposedly in working condition, but I encounter graphical corruption immediately with any game I play. Card is a 7800GT. I can toss in a 8500GT and everything is fine. I know, there are tons of posts on NVRM Xid messages, and there seem to be a number of causes.

I bought the card because a 7600GT was starting to fail with the same message. The card was over a year old, I figured the soft locks were just GPU errors and it was failing. Now this card does the same thing, although it is also used.

I've tried the cards in two systems, same result. The 8500GT works fine in both systems. Any clues, or am I right that this message would constitute hardware failure? Thanks.

Some details.. also found in attached bug report.. not sure what would be best to list. Kubuntu 32 bit, PCIE, 400W coolmax PSU, unhooked everything in the system except mobo, gfx and primary HD.
