Default kernel oops after unsuccessful hibernation

When hibernation abort because of insufficient swap space, the screen turns blank, and kernel log shows kernel oops caused by nvidia module.

maybe you solve this problem at first, then maybe NVIDIA won't oops your kernel.

This kernel oops only appear after aborted hibernation, if I have enough swap space to hibernate, everything works fine.

The kernel isn't supposed to oops because of a aborted hibernation, is it?

BTW:nvidia driver version is 256.44, haven't tried newer drivers, because they don't work on my computer.
