ridiculous patents strike again. Dates back to mid 90's patents, but it "can" affect any electronic device on the planet.

Namely HTC was found guilty of infringing on:
U.S. Patent No. 5,946,647: "A system and method causes a computer to detect and perform actions on structures identified in computer data."
U.S. Patent No. 6,343,263: "A data transmission system having a real-time data engine for processing isochronous streams of data includes an interface device that provides a physical and logical connection of a computer to any one or more of a variety of different types of data networks."

Apple isn't wanting a settlement, they want to ban ALL htc, Motorola, and Samsung devices who use Android.

Yet Apple stole Android's method of notification.

It's not necessarily HTC, it's anything Android; Apple is merely targetting HTC and Samsung first because they are the biggest producers of Android devices. Other Android OEM's will follow.

Apple is really sh*tting their pants right now about Android because it's rapidly taking customers away from iOS. Just look at the numbers bacon12 posted, Apple is losing bad right now (Android has already surpassed iOS in the total market share,) and their numbers are rapidly dropping. This is really bad for Apple because iOS devices make up a massive chunk of their revenue (upwards of 40%.)

Apparently Apple thinks they need to sue them, not for a settlement, but to ban them from importing phones.

@Rakeesh...add Motorola along with Samsung and HTC.

bacon's graph only shows to Jan 2011. I think some time in April, Android took over as top phone OS.

The only reason that Android has taken over is because you get it on every single device out there, from 100-700 dollar phones, from almost every single manufacturer. Compared to the iOS which is offered only on 2, very expensive models, the 3GS and 4... And in case anyone says anything, I am currently on my 3rd iphone (Iphone 4) and my 4th Android phone (Xperia Arc). I own two. Ditched my Windows 7 Phone due to the lack of apps...

You forgot the iPad and iPad2, but you also should include Android tablets too.

But you bring up a point I've always wondered about.

Why doesn't Apple ditch the hardware, and just sell the OS? They would make a killing, and possibly surpass MS. I think the hardware is holding back Apple.

Apple makes some fine hardware, so why not keep doing what you do best? I think the iPhone 4 is the best looking/feeling phone I've ever used. Thin, light and has an awesome screen. Apple knows they make some of the world's best devices so why would they Not limit their OS on their hardware?

I currently have my beef with Android and I honestly think the whole platform is sloppy, not to mention the lack of apps. I've yet to use an Android device that is real smooth, it's always laggy in some form or fashion (laggy keyboard, laggy web browsing, etc). Also I hate that Google and other companies still support such a wide range of versions. Why? Why not standardize across the board? This might not matter to the enthusiast that roots, but what about the average joes? What about the people who just want a phone that works and operates smoothly?

This is the phone that I want to own and honestly, iPhone/iOS is the only phone that fits the bill. I don't want to customize anymore, I don't want to "tinker" and root and jailbreak. I just want my phone to work like it should, quickly and smoothly.

As for the lawsuit, I think Apple can get a little overkill with this kind of stuff. But I'm sure that it won't affect either side that much in the end.
