in my case I'm not using any composite manager. I've just metacity without compiz.

Turning it off does seem to fix the issue.

Here is the exact card

Appears I spoke too soon. Everything worked fine on a fresh boot but after being up for 36h or so its doing it again.

tested with the latest drivers no changes. some side effects of the same issue (it doesn't actually hit only menu): http://frupic.frubar.net/24731
