Default Hardware specs vs. open driver

I've read in so many threads that the only reason why nVidia does not release the driver as open source were licensing issues. Yet, I wonder why on the other hand there are so many driver developers ( e.g. DRI driver project and others ) complain about not even having the hardware docs of modern nVidia cards ? If the only reason not to release the drivers as open source are licensing issues there is nothing that prevents nVidia from publishing hardware specs ( register description, ... ). That way nVidia would not even have to write the drivers.
